Pope John Paul II has in the past insisted that Catholic doctors not perform abortions or assist women with contraception. But this is the first time he has tried to tell the legal profession what to do. The reaction from politicians and advocates in Italy has been one of dismay at such open interference in civil issues.

This is the last in a series of articles summarizing certain of the federal, New York State and New York City tax consequences of real estate foreclosures, bankruptcies and workouts. The articles will serve as text for a seminar on the tax consequences of these transactions to be co-sponsored by the law firm of Ziegler, Sagal Winters and Real Estate Weekly on June 25 at the Grand Hyatt from 8:30 a.m. to 11:00 a.m. These taxes often present the greatest obstacle to negotiating the surrender of property to a creditor because they require an immediate outlay of cash by the owner at a time when the owner is typically cash poor. Tax liability can result even though the owner suffers an economic loss on his investment and realized no cash proceeds. Furthermore, the taxing authorities — the New York State Department of Taxation and Finance (the “New York State Department”) and the City of New York Deparment of Finance “New York City Deparment”) — have adopted interpretations of these that often have harsh consequences. Many of these interpretations by the taxing authorities have been or will be challenged by taxpayers. This area is very complex, and the real estate owner in financial difficulty should seek tax advice as early as possible to insure that settlements are structured to minimize tax. In addition, tax liability can result even though the owner suffers an economic loss on his investment and realizes no cash proceeds.
Editors Synopsis: The author examines how changes to the Uniform Commercial Code Article 9 relating to promissory notes secured by real estate mortgages may affect priority disputes between secured parties and the Internal Revenue Service. This analysis proceeds upon the following basic assumptions: First, the holder of a note and mortgage may transfer that holders rights in the instrument by a document of assignment without a physical delivery of either the note or mortgage. This concept is implicit in the Article 9 provision for automatic perfection of an absolute assignment of a promissory note.6 Otherwise, because possession is also a method of perfection,7 the provision would be superfluous. Second, attachment (i.e., creation) of a security interest8 in Article 9 collateral, including a promissory note, requires either (1) a security agreement authenticated by the debtor, or (2) possession of the collateral by the secured party pursuant to an agreement.9

This part starts with a historical account of the role of the Central Bank of Canada since its creation in 1934. Then, the author develops an interesting chapter about the proper role of a central bank for financial stability by looking at the Canadian experience regarding bank supervision, settlement management, systemic and liquidity crises, and the lender-of-last-resort operation. The Central Bank of Canada never has been directly involved in the supervision of banks, and John Crow is rightly unhappy with this situation: “The Bank and what it knows cannot be ignored in supervisory decisions regarding financial institutions” (p. 77). The second part of the book analyzes the Canadian experience concerning foreign affairs. The most interesting part concerns exchange rate matters. Canada has a long tradition of a flexible exchange rate regime. The author shows the importance of communicating with financial market actors to limit disruptions in the exchange rate, but he also recognizes that the willingness to be transparent can lead “to confusion instead of clarity” (p. 120).

Creighton Engineering Inc.s fire risk management business is ablaze, says company President Scott Creighton. From 1996 until 2004, Creighton Engineering completed about a dozen risk engineering projects in Washington state, he says. Since 2004, its range has increased, and the company has done work for 75 to 100 clients in Washington, Idaho, Oregon, and Montana, Creighton says. Risk engineering is used to obtain the lowest possible fire insurance rates through effective spending on fire-protection system installments, Creighton says. For a cost of between $500 and $5,000, the company evaluates both planned new construction and other buildings for potential improvements that can save money on insurance over time.
KEEPING A BUSINESS fire-safe takes more than just fire extinguishers and automatic sprinkler protection. It also takes educa!tion and training for building occupants. According to a 10-year study of fires at facilities insured by FM Global, people either directly or indirectly caused about 73 percent of them. The average cost per fire was $1.5 million. The “human element” poses risks even before a facility is built or a site selected. For example, some building designers might be using the same building materials and design features for all geographic locations, without regard to natural hazards. Wood is a good choice for a seismic area because it flexes. But in an area subject to windstorms, wood as a building material is a disaster. And when a property is damaged in any natural disaster - like an earthquake or a flood - it is more vulnerable to an ensuing fire.

So those little oboe and/or clarinet and harp diversions in the first movement come on like ancient airs and dances; so there is nothing remotely faceless about the woodwind “couplets” of the second movement; so the third movement “Elegia” stretches and intensifies the dynamic possibilities, suggesting a lake of tears to shame even Bluebeard, with ardent violins pulling more sound up from their bottom strings than Ill wager even they thought they had. When did you last hear the cor anglaiss plangent canon to the lyric main theme of the “Intermezzo interotto” sound this purposeful? And since when did Till Eulenspiegel get to play tag with the Shostakovich “Leningrad” theme? All right, so the finale sacrifices fire to the rustico character of the music (presto? hardly), so youre listening to the Royal Philharmonic thinking of the Chicago Symphony. But theres more music being made here than in the average Concerto for Orchestra - and thats a fact. The Divertimento, meanwhile, is further testament to Gattis work in progress with the RPO strings. Folk dance and fiddling are at the heart of this piece, the character once again dictating the sound. Which is just as it should be and so rarely is. Edward Seckerson

We studied peridural fibrosis in 16 dogs after laminectomies at the L2, L4 and L6 levels. They received either a free fat graft, a biodegradable mechanical barrier (polyethylene oxide (PEO)/polybutylene terephthalate (PBT) copolymer), or no treatment. Sir: I suspect that the earliest example of road rage is in fact that displayed by the Sumerian hero Gilgamesh, who predates Greek and Biblical offenders by hundreds of years. Just before the famous account of the flood, we read that as he is walking down the road towards the sea, looking for eternal life, a young woman tells him he cannot go on. “Seized with anger”, he snatches an axe and a dagger, rushes down and damages the boat. After “talking it over” with the boatman, however, he calms down and agrees to build a replacement craft. Is this the earliest reference to road rage counselling and community service for offenders?

The tremendous growth of the Internet as an advertising medium has been widely documented in a variety of published articles and reports. Although advertisers still invest more than 45 percent of their media budget in newspaper and television, the Internet Advertising Bureau (IAB) estimates that more than $900 million was spent on Internet advertising in 1997 and projects that the end-of-year figures for 1998 will show an expenditure of at least $2 billion. Business Week predicts that ad spending on the Internet will be close to $8 billion by 2002.1 One important reason why revenue is increasing at such a rapid rate is that many ol the more established and popular Web sites are charging more for their ads. In general, advertisers pay for their ads on a “cost per thousand” (CPM) basis, i.e., advertisers pay a fee for every thousand times their ad is viewed. CPM rates for television range from $5 to $6 per thousand. A FIGHT to keep specialist plastic surgery facilities in the Black Country for adult patients has failed to win the backing of health authority bosses. Maybe–If Youre a Subchapter S Corporation In the earlier case, the Court had recognized that, as a Subchapter S corporation, ISNs income tax liability is passed through to its sole shareholder (530) and held that state income taxes paid by the shareholder are allowed under the Taxes provision. (531) However, when ISN returned to Court to seek the same result for its fixed-price contracts, the Court easily dismissed its claim, pointing out the fundamental difference between cost-reimbursement and fixed-price contracts, with the contractor being responsible under the latter for all costs and resulting profit and loss. Additionally, the Court found ISN was not entitled to any lost profits under its cost-reimbursement contracts based on its claim that its negotiated fixed-fee for those contracts should have been greater because the costs should have included the state tax costs (which the earlier decision found to be reimbursable). The Court held that to do so would violate the prohibition against cost-plus-percentage-of-cost contracts (532) and would lead to a windfall. (533)

Pest controllers locate, identify, repel, and destroy pests. They use their knowledge of pests habits, along with an arsenal of pest management techniques-applying chemicals, setting traps, operating equipment, and even modifying building structures-to alleviate pest problems. The best known method of pest control is pesticide application. Pest controllers apply two different types of pesticides: common use and restricted use. Morgan D. (1996). The principles of hypnotherapy. Bradford UK: Eilidon Press. The book is divided into three parts. Part A consisting of 9 chapters covers foundational material on systems theory and how that can be applied to organic systems and to hypnosis. It discusses positive feedback loops that amplify the process and negative feedback loops that subdue the process. Positive feedback amplification can be either beneficial or harmful depending on whether increasing the effect is desired, while negative feedback calming can be either beneficial or harmful depending on whether decreasing the effect is desired. Morgan focuses on the activity of a system, the activity of its component subsystems, or the activity of the supersystem of which the system is a component. His main theoretical focus is on whether the activity of the system is increasing, decreasing, or staying the same, as other components change in specified ways. Hypnosis is described in systems terms, not as a “state,” but rather in terms of what system or subsystem components are changed, either increased or decreased, during trance induction, deepening, maintenance, trance work, and termination. He uses simple symbols to represent activities in quasi-mathematical style, which is helpful. Some of the letter symbols are used for different activities in different parts of the book. It would have been easier to follow if given letter symbols had been used more consistently to represent single specific activities. Some of his textual references to others publications are found in the bibliography at the end of the book, but some are unfortunately not present in the bibliography. He goes through common hypnotic tests in Chapter 8 and inductions in Chapter 9 explaining them in systems terms. This does produce some greater conceptual clarity with respect to subsystem component activities during hypnosis. Part B consisting of 6 chapters is the central discussion on what the systems approach can teach us about hypnotherapy. Chapter 10 discusses the matter of diagnosis in systems terms looking at precursors, problems, and resultants, and how they change with respect to one another. Chapter 11 focuses on positive and negative feedback loops in organic systems including behavioral, emotive, and cognitive. The vicious circle is a positive feedback loop with harmful consequences. Thinking in systems terms may make needed changes clearer to the therapist. Chapter 12 looks at the consequences of symptom reduction. The remaining three chapters in this part examine making changes by choosing the appropriate positive feedback loops to amplify desired effects and the appropriate negative feedback loops to quiet undesired effects, planning the changes, and reinforcing the changes by selecting natural reinforces.
In therapeutic interviews described as either hypnosis or biofeedback, the patient must change mental imagery to achieve the desired state or physiologic change. If the therapists monitors physiologic measures while coaching a patient through a self-hypnotic exercise, invariably there will be changes in measures (e.g., increased peripheral temperature, decreased pulse rate). Regardless of the confusion, the benefit of adding physiologic monitoring (biofeedback) to hypnosis is the enhancement of a sense of personal control and competency. Children recognize that by changing their thinking, they can impact body processes. This makes the experience more concrete and provides trance ratification and gives a child increased confidence about achieving the desired therapeutic outcome. Irritable bowel syndrome (IBS) is common, with each UK GP seeing an average of about eight patients every week. It is unpleasant for sufferers, negatively affects quality of life, and is expensive for health services. A large proportion of patients do not do well with conventional therapy, and many seek unconventional alternatives. One of these is a form of hypnotherapy known as gut-directed hypnotherapy. It is based on relaxation to try to normalise gut function. Because there are claims that it works, some purchasers are tempted to provide a service. A systematic review of trials [1] suggests a large degree of caution is warranted. Authors sought studies, of any design, in nine electronic databases, and even contacted authors for information about any further studies.

Gosse v. Navistar Intel Transp. Corp., 605 NW 2d 896 (Wis. Ct. App. 1999). A Wisconsin appellate court held that a consumer cannot bring a personal injury claim under the states lemon law. Affi-ming, the appellate court noted that the purpose of the lemon law is to give consumers a means to ensure that a new vehicle will conform to its warranty. The law is violated when a vehicle does not conform to its express warranty and the manufacturer fails to fix the nonconformity, replace the vehicle, or give the consumer a refund. Allowing consumers to bring personal injury claims under the statute, the court observed, would impermissibly expand its scope and run contrary to the laws purpose. If a vehicle is so defective that it causes personal injury to a consumer, the court concluded, the consumer can pursue lemon law remedies and bring a separate claim for personal injuries under the appropriate law.

Shoppers are carrying nearly $1,000 less than last year in credit card debt, a sign they will be spending more this holiday shopping season. A recent survey by Rockville-based Myvesta.org, a consumer education organization, found Americans have an average credit card debt of $2,294 this year, down from $3,250 in 2002. One analyst believes the rise in mortgage refinancing is allowing consumers to pay off credit card debt.
MOST READERS of Malaysian Business are not poor. Any customer paying no more than the minimum amount each month on a number of cards is already over-indebted, with debts about to spiral out of control. “Minimum payment information needs to be shared among creditors so they can make better decisions.”

Sylla came to music production through a friend from Ivory Coast who wanted to record Cuban songs in an authentic style. “I got into making suggestions about how to go about it, and how to arrange them,” he says. His recording break came with Orchestra Baobab in 1979 at the legendary Golden Baobab studio in Dakar, now part of Xippi studios, run by Youssou NDour. His production role has been shaped by his extensive terms of reference. “I travelled all round central Africa with my parents, and when I was in Paris I collected all these Cuban records, along with soul and other styles, and I think I bring this to artists. “With Baobab in the Seventies, everyone was doing rumba, but I was the man who actually had the huge record collection and was able to point them in the right direction. Salif Keita was looking for something revolutionary, so I suggested putting him in touch with someone from the West who had the same avant-garde approach. That was Francois Breant - and basically I let them get on with it.”

Chelators added to pectinase-rich enzyme mixtures increase the efficiency of enzyme retting of flax. The multitude of available chelators requires research to optimize enzyme retting for cost and fiber quality. Of several chelators tested, ethylenediaminetetraacetic acid (EDTA) is the most effective in sequestering calcium from solution, with substantial activity even at pH 4 or 5. Phosphate is also effective, but only at high pH. EDTA and Mayoquest 200, a commercial product with -37% EDTA, in combination with Viscozyme L or Lyvelin, commercial enzymes with polygalacturonase activities, yield high Fried test scores, indicating efficient separation of fibers from core tissues. Neither chelator nor enzyme at the levels tested alone effectively rets flax at a pH of around 5. In contrast, EDTA at 20 mmol/L levels and alkaline pH yields high Fried test scores. The addition of BioPrep, a commercial pectate lyase, does not influence retting measured by the Fried test with EDTA at alkaline pH, but the enzyme does improve retting with the weaker chelator sodium tripolyphosphate.
